These terms apply to emails and attachments sent by ATCL Consulting Pty Ltd or Adam James Torta. If these terms are inconsistent with an agreed written engagement, contract or other formally agreed terms, the terms of that engagement or contract take precedence.

Emails and attachments may contain confidential or legally privileged information and are intended solely for the named recipient.
If you receive an email in error, please notify the sender immediately and permanently delete the email and its attachments. You must not use, disclose, distribute or copy information contained in an email that was not intended for you.
ATCL Consulting provides commercial, project-management and construction advisory services and is not a law firm.
Nothing contained in an email from ATCL constitutes legal advice. Recipients should obtain independent legal advice when advice on legal rights, obligations or interpretation is required.
Unless an email expressly identifies information or documentation as a final deliverable issued under an agreed engagement, it should be treated as general, preliminary or working information.
Information is prepared using the documents, assumptions and circumstances reasonably available at the time. It may require revision if further information becomes available or the relevant circumstances change.
Draft estimates, measurements, quantities, calculations, commercial positions and contractual interpretations must be independently checked before they are relied upon for pricing, procurement, payment, contractual action or construction.
Formal deliverables may only be used for the purpose and by the recipient for which they were prepared, subject to the scope, qualifications, limitations and terms of the applicable engagement.
Nothing in these Email Terms excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified.
Subject to those rights and the terms of any applicable engagement, ATCL Consulting Pty Ltd does not accept responsibility for reliance on:
ATCL bank-account details will never be changed solely by email.
Any email requesting payment to new or changed bank-account details should be treated as potentially fraudulent. Before making payment, confirm the account details verbally with Adam using a telephone number already known to you or independently obtained from the ATCL website. Do not use a telephone number supplied only in the email requesting the change.
Electronic communications may be delayed, intercepted, corrupted or affected by malicious software.
While reasonable precautions may be taken, ATCL cannot guarantee that every email or attachment will be secure, complete, error-free or free from harmful components. Recipients are responsible for performing appropriate security and virus checks before opening or using attachments.
Personal information received or transmitted through email correspondence is handled in accordance with the ATCL Privacy Policy.
